GENERAL TERMS AND CONDITIONS AND COMPLAINTS PROCEDURE FOR THE SALE OF THE 2024 IIHF ICE HOCKEY WORLD CHAMPIONSHIP TICKETS
 
(hereinafter referred to as the “Terms and Conditions”)
 
 
Article I
Introductory Provisions
 
  1. These Terms and Conditions are issued by Český svaz ledního hokeje z.s., having its registered office at Českomoravská 2420/15, 190 00 Prague 9, reg. No.: 005 36 440, registered in the Register of Associations maintained by the Municipal Court in Prague, Section L, File 852 (hereinafter referred to as the “Promoter” or “ČSHL”) and CZ.HOCKEY, s.r.o., with registered office at Českomoravská 2420/15, 190 00 Prague 9, reg. No.: 197 55 864, registered in the Register of Associations maintained by the Municipal Court in Prague, in section C, file 39112 (hereinafter referred to as "Co-organizer" or "CZ.HOCKEY”)  regulate the rights and obligations arising from the sale of Tickets between CZ.HOCKEY  and third parties, natural persons or legal entities (hereinafter referred to as the “Customer”), as well as between these persons and entities, and all related relationships.
 
  1. Sales and billing services are performed by:
 
  1. Ticketmaster Česká republika, a.s., having its registered office at Jungmannova
26/15, 110 00 Prague 1, reg. No.: 601 92 577, registered in the Commercial Register maintained by the Municipal Court in Prague, Section B, File 2249 (hereinafter referred to as “Ticketmaster”), operating the Ticketmaster sales network for the sales
  1. IRSnet CZ, s.r.o., having its registered office at Politických vězňů 934/15, 110 00
Prague 1, reg. No.:267 32 122, registered in the Commercial Register maintained by the Municipal Court in Prague, Section C, File 90221 (hereinafter referred to as “IRSnet CZ”) operating the TICKEPORTAL sales network (hereinafter referred to as “Ticketportal”) for online sales
 
(hereinafter collectively referred to as “Ticket Operators”)
 
  1. The Co-organizer shall be responsible for the execution and delivery of the Event offered. By purchasing the Ticket, a contractual relationship is established directly between the Customer who purchases the Ticket and the Co-organizer.
 
Article II
Definitions
 
  1. Promoter”: Český svaz ledního hokeje z.s. (Czech Ice Hockey Association), in cooperation with the International Ice Hockey Federation (IIHF), is the promoter of the 2024 IIHF Ice Hockey World Championship, concluding an agreement for the sale of Tickets with the Customer.
  2. "Co-organizer": Český svaz ledního hokeje z.s. (Czech Ice Hockey Association) ensuring, in cooperation with the International Ice Hockey Federation IIHF, the organization of the 2024 IIHF Ice Hockey World Championship, which concludes a contract for the sale of Tickets with the Customer.
 
  1. Customer”: A person using the Ticket Operators' Sales Network and the Co-organizer's services after entering into a contractual relationship with the Co-organizer to participate in the Event, even prior to entering into the contractual relationship.
 
  1. Event”: The 2024 IIHF Ice Hockey World Championship.
 
  1. Event Occasion”: Individual ice hockey games within the Event.
 
  1. Ticket”: A document (valuable) entitling the Ticket Holder to a single entry to the Event or an individual occasion thereof, intended for one-time use. The Customer may receive graphically different types of Tickets through various Ticket Operators' Sales Networks. The Ticket price includes VAT at the statutory rate. By presenting the Ticket upon entering the Event venue, the person exercising the rights attached to the Ticket accepts the operating regulations of the Event venue and submits to the instructions of the Co-organizer and other regulations of the Event relating thereto.
 
  1. Ticket Operators' Sales Network”: The system operated by one of the Ticket Operators, primarily ensuring the execution, ordering, booking, and sale of Tickets for the Event. This interface is accessible from the Event's official website: 2024.iihfworlds.com/tickets or from the Ticket Operators' websites.
 
  1. Service”: For the purposes hereof, the Service shall mean the sale of Tickets for the Event through the Ticket Operators' Sales Network.
 
  1. Ticket Holder”: A Customer who has purchased a Ticket through an official ticket operator, i.e., holds the Ticket as the proper holder.
 
 
Article III
Ticket Sales
 
  1. The Service may be requested through the Ticket Operator's Sales Network. For this purpose, it is necessary to correctly enter and submit all the data required for the order, reservation, and purchase of the Ticket (name, surname, e-mail, telephone) and then proceed with the cashless online payment. A maximum of eight (8) Tickets for one Event Occasion per booking in one price category may be ordered and purchased through the Service.
 
  1. A Ticket order shall be created by the Customer by correctly entering and submitting all data required to purchase a Ticket through the Ticket Operators' Sales Network in accordance with the procedure described in Article III hereof. The operator of the Service shall be one of the Ticket Operators.
 
  1. The procedure for concluding a purchase agreement, i.e., purchase of Tickets is as follows:
 
  1. The Customer shall access the Ticket Operators' Sales Network and select that they are interested in purchasing an Event Ticket for the relevant sector and specific numbered seats. Available seats shall be represented by the displayed check box. The seat selection is carried out by clicking on the checkbox. Selected Tickets shall be represented as ticked boxes. The Customer shall be able to select from multiple sectors and seats (if available) for the Ticket. The cart (price) field shall display the current total amount of the selected Tickets. After the above selection of Tickets, the Customer shall press the order button.
 
  1. The Customer shall truthfully fill in the required data: name, surname, e-mail, telephone number (hereinafter referred to as “Personal Data”) and subsequently check their accuracy. In the event of providing false data, the Co-organizer reserves the right not to accept the Customer's order or to withdraw from the agreement by sending a statement to the Customer's e-mail address.
 
  1. After completing the details, the Customer shall press the pay button and shall then be transferred to the payment method listing. The Customer shall complete the payment via the GoPay or ComGate payment systems. The agreement shall be concluded upon completion of the payment. Following the payment, the Customer shall receive the Ticket(s) to the Event Occasion ordered to the e-mail address provided during registration.
 
  1. By ordering a Ticket, the Customer agrees to the wording of these Terms and Conditions and agrees to be bound by them in the event of entering into the agreement. In the event of any problem during the Ticket order process that prevents it from being completed, the Customer may contact one of the communication channels of the relevant Ticket Operator:

  1. Information for the Customer (consumer):
 
  1. A consumer shall be any person who, outside the scope of their business activity or outside the scope of the independent exercise of their profession, enters into an agreement with an entrepreneur or otherwise deals with them.
 
  1. The Customer shall pay the price of the Ticket upon ordering the Ticket. The cost of the means of communication with the Co-organizer (i.e., internet services) shall be governed by the price of the services that the Customer uses for this purpose with the service provider of their choice.
 
  1. The Customer shall be obliged to become acquainted with the date of the Event Occasion to which the Ticket relates. The Customer expressly agrees to the provision of the Co-organizer´s services on the date of the Event Occasion. The agreement concluded pursuant to Article III(3) binds the Parties until the end of the Event Occasion to which the Ticket relates and unless otherwise provided herein. The Customer acknowledges that, in accordance with Article 1837(j) of Act No. 89/2012 Coll., Civil Code, they shall not be entitled to withdraw from the agreement concluded pursuant to Article III(3), using the procedure set out in Article 1829 of the Civil Code (i.e., they may not use the option to withdraw from the agreement within 14 days without stating a reason, which is otherwise generally available for other online purchases).
 
 
Article IV
Disposing of the Ticket
 
  1. The Ticket Holder may not resell the Ticket or use it for promotional purposes (e.g., for competitions and consumer lotteries) without the consent of the Co-organizer or the Event organizing committee. The Ticket Holder shall further refrain from any parasitic use of reputation of the Co-organizer and the official partners of the Event.  For more information, please refer to 2024.iihfworlds.com in the Tickets section and the Marketing Rules subsection. This is set out in the binding Licensing Terms and Conditions on the back of each Ticket. Under these Terms and Conditions and the Event's Visitor Regulations, the Ticket or any significant part thereof may not be used by the purchaser or the Ticket Holder in connection with any promotion (including competitions and consumer lotteries) of the purchaser or the Ticket Holder or any products or services for any commercial or other purpose.
Any violation hereof shall constitute an unfair competitive act meeting the elements of the offence of parasitic use of reputation pursuant to Sections 2976 et seq. of Act No. 89/2012 Coll., Civil Code, or other offences of unfair competition, and in certain circumstances may also qualify as a criminal offence of violating the competition rules pursuant to Section 248 of Act No. 40/2009 Coll., Criminal Code. Any person who commits this offence therefore faces, inter alia, the risk of criminal prosecution.
 
  1. In the Event Occasion venue, the Ticket Holder shall comply with the Event's Visitor Regulations and all instructions of the Co-organizer. According to the Visitor Regulations, it is not allowed to engage in any marketing, advertising, or other activities parasitical to the Event. Any person who violates this restriction may face criminal sanctions and be subject to recovery of damages.
 
  1. The Ticket is a valuable item and any alteration or forgery thereof is prohibited. Any violation hereof may be considered a misdemeanour or a criminal offence and the person who commits such violation shall face, inter alia, the risk of criminal prosecution.
 
  1. Any person attending the Event shall not record, transmit, or in any other manner disseminate over the internet or any other media, for commercial or otherwise, any sound, image, or description, or results of the Event, in whole or in part, or assist any other person/s conducting such activities. It is prohibited to take into any arena where an Event game is being played any equipment or device produced with the main purposes capable of being used for any of the activities identified above (except for mobile telephones provided that the phone is only used for bona fid personal and private call making/receiving).
 
Article V
Redeeming the Ticket
 
  1. The Customer shall print the purchased Ticket legibly and use it upon entry to the Event.
 
  1. The Ticket shall be validated at the entrance to the hockey arena in which the Event takes place, i.e., PRAHA ARÉNA in PRAGUE and OSTRAVA ARÉNA in Ostrava (hereinafter referred to as the “Arenas”). In the case of problems with scanning the purchased Ticket, the Customer shall contact the attendants at the ticket offices of the respective Arena.
 
 
Article VI
Complaints Procedure
 
  1. All complaints regarding the purchased Tickets shall be governed hereby and by the Terms and Conditions of the respective Ticket Operator through which the Tickets were purchased in accordance with Article III hereof.
 
  1. The Customer may refer to the Terms and Conditions of the relevant Ticket Operator:

  1. Neither the price paid for the Tickets nor any other amounts paid by the Customer in connection with the purchase of Tickets on the Ticket Operators' Sales Network shall be refundable unless otherwise expressly stated below.
 
  1. The purchased Ticket is not exchangeable for a new one or for a different one. No form of compensation shall be provided to the Customer in the event of damage, destruction, loss, or theft of the Ticket.
 
  1. In the case that the Co-organizer cancels or reschedules the Event or an individual Event Occasion completely, the Ticket Holder shall be notified of the fact and the next course of action via the contact details provided by the Ticket Holder when purchasing the Tickets (primarily by e-mail). In this regard, there is no guarantee that the Co-organizer or any of the Ticket Operators will be able to provide the Ticket Holder with notice of cancellation or rescheduling of the Event or individual Event Occasion in a timely manner and with sufficient notice.
 
  1. If the Co-organizer cancels the Event or an individual Event Occasion, the Ticket Holder shall be notified in a similar manner to the previous paragraph of the possibility to receive a refund of the amount paid for the Tickets purchased. The refund procedure shall be governed by the Terms and Conditions of the relevant Ticket Operator.
 
Article VII
Privacy Policy
 
  1. The processor of the Customer's personal data shall always be only the relevant Ticket Operator through whose sales network the tickets are sold according to Article III hereof, and who shall always process the personal data in accordance with the applicable legislation, i.e., Act No. 101/2000 Coll., Personal Data Protection Act (hereinafter referred to as the “Act”) and the EU Regulation 2016/679, General Data Protection Regulation, which in some respects replaces the Act (hereinafter referred to as the “Regulation”).
 
  1. The Customer may refer to the specific instructions on the processing of personal data of the respective Ticket Operator:

Article VIII
Final Provisions
 
  1. The Co-organizer shall not be responsible for the accuracy, completeness, or timeliness of the information provided in the online offer of the Event on the Ticket Operators' Sales Network except with intent or gross negligence. If the Co-organizer is aware of any cancellation or rescheduling of the Event, it shall promptly inform the Customers by posting such information on the 2024.iihfworlds.com website.
 
  1. The Customers shall be obliged to become acquainted with the operating regulations of the Event Occasion venue for which they have purchased a Ticket, in particular the Event's Visitor Regulations, the Co-organizer's instructions relating to the Event, and to respect and observe them. The Customer acknowledges that it is not within the Co-organizer's ability to provide a 100% visibility of the entire ice surface during the entire Event Occasion. The quality of the view depends on the specific location in the Arena.
 
  1. Should any provision hereof become invalid, ineffective, or unenforceable, the validity, effectiveness, or enforceability of the remaining provisions shall remain unaffected.
 
  1. In the event that a consumer dispute arises between the Co-organizer or one of the Ticket Operators and the Customer (consumer) under the purchase agreement, which cannot be resolved by mutual agreement, the consumer may submit a proposal for out-of-court settlement of such dispute to the entity designated for the out-of-court settlement of consumer disputes, which is the Czech Trade Inspection at Česká obchodní inspekce, Ústřední inspektorát – oddělení ADR, Štěpánská 15, 120 00 15, 120 00 Prague 2, e-mail: adr@coi.cz, website: adr.coi.cz. In the case of online agreements, the consumer may also use the online dispute resolution platform set up by the European Commission at http://ec.europa.eu/consumers/odr/.
 
  1. These Terms and Conditions come into force and effect on 1 October 2023 and the Co-organizer reserves the right to change them at any time.
